Abstract
Various studies have explored the evidence of racial disparity in sentencing; they have tried to see whether the race of victims or ofenders plays a role in infuencing the decisions of judicial ofcers such as the jury and judges. There have been debates whether racial disparity occurs within the criminal justice system, which is meant to be fair and just to all persons. Racial disparity entails the imbalances and incompatibilities between races in aspects like economic status, housing, safety, income, employment, and incarceration. Evidence reveals that many people have been incarcerated not because of their crimes but because of racial practices in courts. Over the years, criminal justice system in the USA seems to favor White Americans compared to African Americans and Latinos due to the harsher and longer sentences imposed on the minority groups.
